The surveillance of imports from third countries, including toys, is the responsibility of the Member States’ national authorities. Basing themselves on risk-related information exchanged across the EU, customs authorities carry out controls on products that enter the EU; they work in close coordination with market surveillance authorities to identify non-compliant or dangerous products.

Regulation (EU) 2019/1020 /1, applicable as of 16 July 2021, will strengthen controls at the external EU borders by facilitating cooperation between these authorities.

As highlighted in its answer to written question E-001221/2018, the Commission strives to coordinate and strengthen enforcement activities in the EU, including between customs and chemical inspectors. More than 4000 import controls on chemicals regulated by the REACH Regulation /2 are carried out annually, including on phthalates in toys, and intelligence on the subject is shared /3.

As the Commission pointed out in its answer to written question E-004210/2019, REACH restricts since July 2020 the placing on the market of all articles (with very few exceptions), including toys, that contain the phthalates DEHP, BBP, DBP or DIBP /4. This restriction was adopted following the assessment of all available evidence. REACH further restricts the phthalates DINP, DIDP and DNOP in toys and childcare articles /5.
